Julius Malema on Phala Phala Judgement
Economic Freedom Fighters Commander in Chief Mr Julius Malema was addressing his followers outside the Constitutional Court on Friday afternoon . The party took a march to demand the court to release a judgement on Phala Phala scandal that implicates president Cyril Ramaphosa . EFF members came in numbers although the weather was not good on the day .
Malema said " Today it is a proof to the opponents that EFF is here to stay . The EFF will not go anywhere either they like it or not . It is the organization of the people , is the protest movement will always be at the pickets lines when a call is made ; to defend the constitution on the Republic of South Africa . Comrades , you are here to defend the constitution of the Republic of South Africa . The Constitutional Court is not above the constitution . Is a subject of the constitution .
" It's existence comes from the constitution itself . It is not the constitutional court that established the constitution . It is the constitution that established the constitution court . It is the constitution that allows the independence, the judiciary and the judges must act without fear or favour . What we are seeing today for more than a year ; the constitutional court , the highest court in the land cannot produce a simple judgement .
" On whether parliament acted rationally or irrationally when they voted against the parliament panel recommendations . This comrades , the Constitutional Court they must know they have embarrassed the whole country with the best constitution. We were told our constitution is the best ; our constitution will protect us how can the judges not use the constitution to protect the people of South Africa against the criminal who is occupying the office of the president .
" Comrades , we must not forget that Chief Justice Mogoeng Mogoeng said there was an attempt to capture the judiciary . The judiciary start with the constitutional court and Chiefs Justice . If the judiciary is rotten , it gets rotten from the head . We need to stop the rot before it destroy the whole of the judiciary in South Africa. Without judiciary we are nothing . We speak to you now there's a judge that was arrested for corruption . Now we have a proof that judges can be corrupt .
" Why are these judges so scared of Cyril Ramaphosa ? . What would take educated judges to take more than a year , when they address each other ; they say my learned friend . The law is there , role of the judge is not to write the law , is to interprete this thing law , make the judgement. How can it take eleven judges at the constitutional court to produce a single judgement ? . Cases that came after our case on Phala Phala ; they have already made judgements .
" But Phala Phala it's a difficult case . We need to tell the Chief Justice ; that for a long as Phala Phala is not released . Every month we are going to come here to make a picket to demand of the release of the Phala Phala report . We will not allow judiciary to act as if they are above the law . We will not allow the judiciary to act as if they are untouchable. There were dollars in Phala Phala ; there's no secret , everybody agreed including Ramaphosa saying there were dollars in Phala Phala .
" Then he said , he put the dollars in the sofa because the safe was not safe . How can the Sofa be more safe than a sofa itself ? . Fighters how did the dollars find itself inside South Africa . So many millions dollars found their way her. We were told they buy Buffaloes , there's no Buffalo that left South Africa . We hope that G20 did not leave more Dollas for Ramaphosa at his fairm " .
