Judge is bias towards the states
The Senzo Meyiwa murder trial will resume on the 19th of January 2026. Sifiso Zungu was the last witness in 2025 in court, who came to testify that he was assaulted prior to his alleged statement. According to Sifiso Zungu, the police told him that Muzi Sibiya had mentioned him. Zungu said he told the police to copy everything that was said by Muzi Sibiya as his statement. The reasons given by Sifiso are that he wanted to save his life as he was continuously assaulted. State Prosecutor George Baloyi wanted to cross-examine Sifiso Zungu on his alleged statement. Advocate Charles Mnisi objected to that on the basis that the state must first prove the statement on whether indeed the statement was made by Sifiso Zungu, freely and voluntarily.
While waiting for the state to prove the statement, the police in court arrested three men for murder conspiracy. Later on in the day, the police released a statement to say the matter is under investigation. Judge Ratha Mokgoatlheng did not wait for investigations to be concluded; he believed the allegations made by the police, which included the defense team. Ratha Mokgoatlheng went on to say, "I would appreciate it if they cannot shoot me in my face so that my wife can identify me." Infotainment podcast host Bongani told Newzroom Afrika that, according to him, Judge Ratha Mokgoatlheng is trying to save the career of Mr. George Baloyi.
Risk analyst Njabulo Mlawuli told News Central TV on Breakfast Xtra that the judge is biased towards the state and not fair to the accused. Ratha continued to say South Africa is the banana republic because they wanted to kill a judge , he said that based on the allegations which has not been tested . Njabulo said " At this point in time we are currently having the defence who are presenting their case against the five accused persons . Interms of who really was on the crime scene on the 26 of October 2014 where our soccer player Senzo Meyiwa was gunned down . So what we are expirenced in court was the defence started actually with Muzi Sibiya and he had two witnesses that came to testify .
" The first witness was the father of Constable Sizwe Zungu who is Absolom Zungu . We must remember that Absolom Zungu is the person that the state has made their star witness interms of saying that , is the one who provided the break through . The information that led to the arrest of accuse number one to five . The case has been going on for ten years ; now with drama that is currently happening it is making us South African to loose faith into our judiciary system . It also put in , in the spotlight in the state. It is not everyone in the state but few people who are unethical police officers .It has appeared now that most witnesses who will come to testify in favour of the defence are bring threatened .
" it must be noted that these witnesses that are coming in it appears as if , they don't come to testify about what they have scene on the crime scene but they are just coming to court to tell their story, that all the things that you heared the state about us or our names its not true . We don't know anything about instead the state officials are assaulting us and forced us into writing these statements . It must be noted in South Africa that the issue of assault of the witnesses or whistle blowers it comes at the very desensitized time , where also in one of the commission , a whistleblower was gunned down .
